Enforcement of CC&Rs and Local Zoning
Recently I picked up a copy of the September-October Continental Country Club newsletter. I was both surprised and delighted to find that through a lot of hard work a group of volunteers representing the Homeowners Association have been able to get approval from the residents from 11 different subdivisions in the Country Club area to unify their Covenants, Conditions, & Restrictions (CC&Rs).
For those of you living in one of these subdivisions this is good news. The Country Club is one of a few areas in town that vigorously enforce their CC&Rs and when someone visits your neighborhoods it shows. While we all have reasons to sometimes question the rules contained in the CC&Rs the fact is, that enforcement keeps property values at the top of the market.
For the rest of us who have CC&Rs in their neighborhoods but do not have a Home Owners Association (HOA) we are left to take action on our own if we see an obvious infraction. While this seems simple enough on paper, in reality getting your neighbors to comply with subdivisions and zoning rules can be anything but easy.
Without an HOA the responsibility to ensure that zoning laws are enforced falls on local government. The city of Flagstaff Clean and Green department is very proactive and help to insure that city neighborhoods are kept clean and tidy. In Coconino County that task is handled by a zoning enforcement officer.
Whatever organization or agency enforces zoning and CC&Rs in our neighborhoods it behooves us all to work together to keep our communities looking the best that we can. The Continental Country Club is a great example for everyone.
